Freedom of Work for Foreign Citizens on Romanian Territory.
The article analyzes the right to work of foreign citizens in Romania, considering the national and international legal framework as well as the applicable legal regime. It highlights the main rights and restrictions applicable to third-country nationals under Romanian and European legislation, along with the practical challenges encountered in the process of employment and social integration. The study also addresses issues such as the labor market test, professions reserved for Romanian and EU citizens, as well as relevant case law of the ECHR and CJEU. Finally, conclusions and proposals are formulated regarding the need for more flexible legislation and public policies oriented towards the effective integration of foreign workers, in the context of Romania’s labor shortages.
