Constitutional provisions regarding religious freedom and its legal protection in Romania in the years 1858-1938.
The Paris Convention of 17/19 August 1858 – the first constitutional act of European origin whose provisions were also applied in the Romanian area – was followed by three fundamental laws of Western inspiration, namely the Constitution of 1866, of 1923 and since 1938. The adaptation of their provisions to Romanian realities created a new, modernizing spirit of Romanian Law. But this modernization process led to a divorce between the old Romanian constitutional law - represented by the former Settlements of the Romanian Countries - and the Western-inspired constitutional law, which debuted with the Constitution of 1866. Although the text of the 1866 Constitution made an express reference to the “old Constitution of the Country” (Art. 12), however, we could no longer speak of a capitalization of the Romanian constitutional tradition enshrined by the “Law of the Country” and its institutions. From the text of the three Constitutions - which we have analyzed and evaluated both in the spirit of the Romanian constitutional tradition and in that of the European constitutional tradition, valued by the constitutional law of the European Union states, - it can be seen that their authors made express reference and to fundamental human rights and freedoms, including the right to religious freedom.
